The New Castle County Chamber of Commerce has called on the City of Wilmington to repeal a law which creates additional taxation for S-corporation shareholders. Further, the Chamber advocates that Wilmington City Council develop a more business friendly and equitable approach to the taxation of S-corporation income as well as that of other business entities such as LLPs and LLCs.

        According to Chamber President Mark Kleinschmidt, "With this new tax, the City of Wilmington is clearly overstepping its bounds. It is creating an unfriendly business environment that impacts not only Wilmington, but the State of Delaware as well."

        Formerly, individual S-corporation shareholders were required to pay either a net profits tax or an earned income tax. Wilmington is now subjecting these shareholders to both taxes.

"This tax increase on the shareholders of businesses choosing to be domiciled in the City of Wilmington is unfair, excessive and harmful to the already challenging business environment in Wilmington," said Kleinschmidt. He went on to say that, "the City has set themselves up as the arbiter of what is a proper salary versus shareholder distribution. The appropriate breakdown of salary versus distributions should be determined based on IRS guidance, not an arbitrary standard
        developed to maximize income for the City of Wilmington."

"This follows an ongoing campaign of audits that the City has been engaged in for quite some time, about which we have heard numerous concerns." said Kleinschimdt. "They are conducting over 10,000 audits of businesses regarding the wage tax, they have enacted double-digit increases in property taxes and water sewer fees, and they have generally shown an insufficient regard for the disruption they are causing in the business community."

        The Chamber plans to seek legislation from the General Assembly to control the wage tax and audit activity of municipalities.

        "Stolen Bases for Happy Faces" program raises $5,000 for Miracle League Baseball field to be built in Bear, Del.

All season long the New Castle County Chamber of Commerce cheered on thefts, the swiping of bags, and stealing at Frawley Stadium. The Chamber, with the support of the Blue Rocks and six member businesses, came together in an effort to help raise funds for the construction of a Miracle League baseball field for the Bear Babe Ruth Baseball League.

        Each time a Blue Rocks player stole a base at home this season participating county chamber member companies donated $10 to the Bear Babe Ruth Miracle League construction fund.

        "The Stolen Bases for Happy Faces program was very successful and we enjoyed working with the Blue Rocks this season. We plan to partner again in 2011," says chamber president MarkKleinschmidt.

        At a recent home game Kleinschmidt presented a check for $5,000 to officials of the Bear Babe Ruth League. "The Blue Rocks stole 55 bases at home this year so each participating member business donated $550 at the very least. Wilmington University pledged $1,000 and Financial Advisors of Delaware Valley donated the proceeds of a television raffle. The Chamber then rounded the figure up to $5,000, says Kleinschmidt.

        In addition to Wilmington University and Financial Advisors of Delaware Valley the program was also supported by Connolly Bove Lodge and Hutz, Fitzgerald Consulting, Get Life Coaching, and Aerus/Electrolux.

        The Miracle League field is fully accessible to all children with physical challenges. The custom -designed venue incorporates a cushioned, synthetic surface with base paths, bases, batters' box, pitcher's mound, and home plate painted on the surface. This design eliminates barriers for children who are visually impaired, wheelchair- or walker-restricted, or who use any type of mobile device.

        Formed in 1999, the Bear Babe Ruth League has grown to over 800 families and 65 teams playing baseball and softball for kids ages 4-18. The leagueÕs current playing fields are located at Red Lion Academy.

        Obscure Health Care Reform Requirement Has Small Businesses Feeling Sick
New Castle County Chamber of Commerce Calls for Repeal of 1099 Provision

The New Castle County Chamber of Commerce is calling on the U.S. Congress to repeal an obscure but particularly burdensome provision of the new health care reform law.

Under the new law, businesses will now have to gather the necessary identification numbers and billing totals for any person or company with which the company did at least $600 in business.

According to chamber President, Mark Kleinschmidt, “this new requirement will create an avalanche of additional paperwork and higher costs for small businesses, costs that struggling business simply cannot afford.”

Kleinschmidt went on to say that, “we are all familiar with having to file 1099's for freelancers, which means getting the individual’s social security or tax identification number, name, address and the amount they were paid.

Under the new law, this information will now have to be gathered for every company from which they buy at least $600 worth of goods or services. That means if I buy $600 worth of paper from Costco or Staples during the course of the year, I now have to track down their tax identification number and submit a1099 form. This is ridiculously burdensome and will lead to businesses having to change accounting software or hire tax accountants to do the job, resulting in additional costs that few businesses
        can take on, especially in these tough economic times.”

The Chamber is sending letters to all three members of Delaware’s congressional delegation asking them to support efforts to repeal this provision and is asking all of its members to contact Delaware’s congressional offices on the issue.

        “I hope I’m able to get an autograph,” joked Bancroft Construction Company Executive Vice President Nash Childs also Chair of the Board of the American Diabetes Association (ADA), as he discussed presenting the ADA Chair’s Citation Award to award winning singer/songwriter Bret Michaels Sunday, June 20 in Virginia Beach, VA.

        This award is given to recognize individuals who have gone above and beyond in support of the ADA’s mission to prevent and cure diabetes and to improve the lives of all people affected by the disease. Diagnosed with type 1 diabetes at the age of 6, Michaels, according to Childs, is an outstanding role model for this effort. He used his appearance and victory on NBC’s Celebrity Apprentice as a platform to raise awareness of diabetes by donating his $390,000 winning paycheck
        to the ADA. “It was a pleasure to present Bret with this award. He is one of the most congenial people that I’ve ever met.” said Childs “He even gave me one of his signature cowboy hats!”

        ADA is the nation’s largest voluntary health organization leading the fight to Stop DiabetesSM. Childs has been involved with the ADA for the past 23 years. As Chair of the Board, Childs is one of the principal officers of the ADA and is responsible for the oversight of the Association’s business affairs. He also serves as the principal spokesperson and advocate for the Association regarding policy, goals, direction and management of the organization. In addition, he works closely with
        the Association’s volunteers and staff on activities and initiatives in support of the organization’s mission.

        One of the things we are most proud of is the lasting results we achieve with our clients. The personal development field is often cluttered with "feel good moments" but with no sustainability. Our approach has always been one of inside out - creating true change as we teach clients to coach themselves. We are excited to be published and now award winners. Thank you Barbara for your hard work.

OÕToole and more than fifty American Culinary Federation chefs will attend a special event at the White House honoring the Chefs Move To Schools initiative. Mrs. Obama
        has been crusading against childhood obesity with her LetÕs Move! program. This latest partnership supporting the effort includes some of the countryÕs most talented chefs, including Deerfield Golf & Tennis Club's "Chef Paul."

        "It's an incredible honor to be associated with this very important issue," noted O'Toole, who also serves as Chief Culinary Officer of Forewinds Hospitality. "To be a guest of the First Lady on the South Lawn, be selected by my dedicated colleagues at the American Culinary Federation, and work cooperatively to make a difference in the lives of our young people is an exciting
        opportunity."

        "I want to thank them for joining the Let's Move! campaign," said Mrs. Obama, in a White House blog posting on May 13

th.

        Chefs nationwide will get involved in the program by adopting a school in their community and working with teachers, parents, school nutrition professionals, and administrators to help educate kids about food and nutrition.

        "This is just one more example of Chef Paul being a leader, both locally and nationally, in the culinary arts," said Steve Furman, General Manager. ÒDeerfield Golf & Tennis Club is so very fortunate to have Chef Paul delivering creative, flavorful cuisine to our guests and clients every day. It's additionally rewarding to have him recognized on such a big stage,
        and for such an important initiative."

Each time a Blue Rocks player steals a base at home this season participating county chamber member companies will donate $10 to the Bear Babe Ruth Miracle League construction fund.

        "We would like to have ten member businesses as sponsors," says Chamber president Mark Kleinschmidt. "We did our research and we figure the Blue Rocks will steal about 100 bases at home this season so this effort, if we get ten members to sign on, will raise about $10,000."

        The funding is capped at $1,000 so sponsors know the high-end of what to expect. To date the Chamber has five partners signed on: Connolly Bove Lodge and Hutz, Delaware Valley Financial Advisors, Fitzgerald Consulting, Get Life Coaching, and Wilmington University.

        "We expect to get to ten, we have had positive feedback," says Kleinschmidt. The participating member business will be recognized with a Blue Rocks game and the honor of throwing out the first pitch in addition to some other perks. The Chamber will be providing the proceeds from their annual Fall Golf Outing to the construction fund.

        The Miracle League field is fully accessible to all children with physical challenges. The custom-designed venue incorporates a cushioned, synthetic surface with base paths, bases, batters' box, pitcher's mound, and home plate painted on the surface. This design eliminates barriers for children who are visually impaired, wheelchair- or walker-restricted, or who use any type of
        mobile device.

        Formed in 1999, the Bear Babe Ruth League has grown to over 800 families and 65 teams playing baseball and softball for kids ages 4-18. The league’s current playing fields are located at Red Lion Academy.

        Back to Basics Learning Dynamics, the tri-state area’s undisputed leader in one-on-one tutoring for children and adults, was recently recognized by the Better Business Bureau (BBB) with the 2010 BBB Torch Award for exceptional leadership, transparency, and business ethics. An awards ceremony was held at the Hotel DuPont to honor the Wilmington-based firm, which has been serving the varied educational needs of children through adults for over 24 years.

The BBB Torch Award is an annual awards program created to gain public recognition for businesses and organizations that maintain a solid commitment to conducting their business practices in an ethical fashion. The award has become a signature celebration of business ethics in the marketplace and helps to illuminate the importance of corporate conscience, responsibility
        to upholding a fair and honest marketplace, outstanding service, and responsible business practices.

“Since 1985, Back to Basics’ corporate leadership and caring, capable staff have consistently exhibited the many traits and characteristics that merit an honor like the BBB Torch Award,” says Susan McNeill, a parent of a Back to Basics’ student and the nominator responsible for submitting the firm for consideration. “Back to Basics’ incredible success in the education industry simply could not have been achieved without a strict adherence to the crucial tenets that the BBB seeks to recognize
        -- trust, transparency, honoring of promises, safeguarding privacy, and integrity. In business, these traits are admirable -- in an educational institution, these characteristics are crucial.”

Specific selection criteria for the award covered several key areas including:

High ethical standards toward customers, suppliers, employees and communities;
Long-standing history and reputation of ethical practices in the marketplace;
Marketing and advertising that reflects a true representation of what is offered;
Acknowledgement of ethical marketplace practices by peers, media and/or community organizations;
Management practices that give long-term value to shareholders, customers, employees, and vendors, and;
Examples of prudent growth strategies.

“It is an incredible honor for every one of our 90 tutors and instructors to receive this recognition from the Better Business Bureau,” says Beverly Stewart, Founder of Back to Basics. “A sincere approach and the commitment of each staff member to the success of our clients has always been our driving force.”

Jen Groover will settle for nothing less than conquering the business world. Her new book might just help you do the same.

        Ask Jen Groover if she’s aiming for Martha Stewart-type success. She won’t bat an eyelash.

        “Oh, yeah,” she says, with unmistakable confidence.

        Groover, a multi-talented entrepreneur in her mid-30s who created, among other products, the insanely popular Butler Bag, truly could be a Martha in the making.

         Earning descriptions such as “a one-woman brand” and a “serial entrepreneur,” Groover appears regularly as a business and lifestyle expert on such shows as Fox News’ “Strategy Room,” and ABC’s “Money Matters.” A business contributor to the Huffington Post, she is about to debut a new line of products on QVC.

        As if she’s not busy enough, Groover embarks on a 10-city tour this month to promote her new book, “What If? & Why Not?” for budding entrepreneurs. The book is part of Groover’s effort to help others overcome roadblocks to success in business. Of course, she will settle for no less than New York Times best-seller status during her first turn as an author.

        “I’m hitting on something no one else has,” Groover says. “When I launched the Butler Bag, all the naysayers and negative obstacles turned into philosophies to empower me in my own journey. I’m taking all that technical knowledge and combining it with spiritual infusion to give people the mental and emotional capacity and physical ability to accomplish what they want.”

        Groover, originally from Media, Pennsylvania, splits time between offices in Philadelphia and New York City. She started her business career in 1996, when she co-owned and operated The Groove Shop, an aerobics studio in Wilmington.

         The Butler Bag became her first franchise, reaching $1 million in sales the first year. Three years later, it’s hailed as one of the fastest-growing handbag brands in history. Groover has since created a Website for entrepreneurs, Launchers Café, introduced the Leader Girlz brand to teach leadership to young girls through play, and a lifestyle brand of fashion-related products that will be featured on QVC this spring. She also has a couple of TV shows in development.

        “I want to create a play in any industry,” Groover says. “I can transform people’s lives, make them face their fears and overcome them. I feel I can make a difference. I have no limits at all.” —Drew Ostroski

            United Water Delaware has received the 2010 Business and Industry Award from the multi-state Water Resources Association of the Delaware River Basin in recognition of United WaterÕs $6 million Aquifer Storage and Recovery (ASR) Project.

                United Water Delaware's ASR is the first of its kind in Delaware. The process involves injecting treated surface water into an underground aquifer where it is stored for use in times of drought. On the Governor's "A" list to increase drinking water reserves, United Water's ASR project is an innovative, technology-based and sustainable solution to meeting area water needs. United Water's ASR adds 75 million gallons to New Castle County, Delaware water supplies and is expandable to
                225 million gallons.

                "Recommended by the Governor's Water Supply Coordinating Council, United Water's ASR project represents a significant investment in the communities we serve and is a prime example of successful coordination with public water and regulatory agencies," said United Water Delaware General Manager Susan Skomorucha.

                Aquifer Storage and Recovery involves injecting drinking water into an aquifer through deep wells and then pumping it out or "recovering" it when needed. The aquifer, an existing underground layer of water-bearing sand and gravel, essentially functions as a water bank. Deposits are made in times when water is plentiful, typically from fall through spring. Withdrawals occur when available surface water is restricted during dry conditions in the summer. Like a savings account is to
                money, ASR is to water. Deposits are made when extra surface water is available and withdrawn in times of shortage.

                At a rate of over 200 gallons per minute, United Water Delaware first began storing drinking water 750 feet down in the Potomac Aquifer in October 2008. ASR will provide one million gallons of drinking water a day when needed in the summer of 2010, to ensure adequate supplies during dry periods. United Water's ASR, the City of Wilmington's expansion of Hoopes Reservoir, and the City of Newark's construction of its own reservoir all received the same sound and prudent support from
                a broad spectrum of the Delaware water resources and regulatory community.

        University of Delaware President Patrick Harker urged business leaders in Delaware to remain committed to high ethics.

        "Successful business helps create successful society. Successful society is based on integrity and trust," Harker told a ballroom full of people at the Hotel du Pont on Tuesday. Harker was the keynote speaker at the 45th annual dinner of the Better Business Bureau of Delaware.

        Harker said managers have broader moral responsibilities than individuals because they're responsible for ensuring that groups of people conduct business in an ethical manner.

        More than 200 people, including business owners and local sponsors, attended the event. Sen. Tom Carper arrived from Senate hearings dealing with questionable ethical practices by investment banking giant Goldman Sachs.

        "Integrity is something that if you have it, you have it -- and if you don't have it, you don't have it," Carper said.

        Several awards were given to businesses in Delaware for maintaining high standards in their communities through the year. Award winners included Lucille Avakian Oriental Rugs, J. Christian Studio, New Castle Dental Associates, The News Journal Media Group and Back to Basics Learning Dynamics.

        Milford High School senior Marcy McKee received a standing ovation as the first recipient of the student ethics scholarship. McKee, who will be going to college in North Carolina in the fall, wrote an essay on good business ethics. She received a $2,500 scholarship.

        Brian Pevec, a new member of the board of the BBB and president of Newark Door & Window Company Inc.,said the benefits of joining the BBB are clear to him.

        "In my line of business, I wanted to stand out," Pevec said. "It has been great since I joined. I've learned so much."

                Wilmington, Del. –

The U.S. Small Business Administration (SBA) has selected Bobby Pancake and Steve Wheat, owners of High 5, LLC, doing business as Buffalo Wild Wings, as the recipients of its National Entrepreneurial Success Award. The entrepreneurs will be honored at National Small Business Week on May 23-25 in Washington, DC and at Delaware’s Small Business Week Awards dinner on June 8 at the Waterfall Banquet and Conference Center in Claymont.

                The SBA Entrepreneurial Success Award honors a larger successful business that received SBA assistance in the early stages of its growth. Pancake and Wheat own the Buffalo Wild Wings franchise market covering the entire state of Delaware and three counties in Maryland.

                The business owners started the business in 2004 with several SBA guaranteed loans to finance its first three restaurants in Dover, Middletown and Bear. Today the business has six locations including Wilmington, Newark and Bel Air, Md., with annual sales of $13.2 million and more than 400 employees. They were nominated for the award by John Matarese, portfolio manager of Wilmington Trust.

                “We would like to offer a special thanks to Wilmington Trust for not only nominating us, but for standing with us as we continue to expand,” said Pancake of High 5, LLC. “This accomplishment is not possible without the support of our great managers and outstanding team members.”

                This is the first time that a Delaware business has been recognized by the SBA with a national award at Small Business Week according to Jayne Armstrong, district director of the SBA’s Delaware District Office. “My co-workers and I are thrilled that Bobby and Steve’s success is being recognized on the national level. I can’t think of two more deserving entrepreneurs.”

                Pancake and Wheat also credit the SBA for getting behind their business when no one else would look at them. “If it hadn’t been for the SBA, we never would have gotten the restaurants off the ground,” said Wheat.

                The business partners met while working for Buffalo Wild Wings, Inc., when Pancake was the senior director of company operations and Wheat was the local store marketing manager. They spent many business trips discussing their dream of owning their own restaurant and developing their business plan. At the time the franchise was in the process of transitioning from a local wing restaurant targeting college campuses to today’s national model of a suburban, family-oriented sports bar and grill.

                Pancake and Wheat recognize their success is a testament to the Buffalo Wild Wings brand. They opened the first location on the East Coast as the national franchise expanded from 50 restaurants to more than 625 locations today.

                The SBA Entrepreneurial Success Award is based on the business’ staying power, growth in number of employees, increase in sale and/or unit volume, current and past financial performance, SBA assistance, innovation of product or service offered, response to adversity and contributions to community-oriented projects.
